Author retains 100% ownership of the rights and copyright licenses. Author grants to Kingdom Winds LLC and Kingdom Winds Publishing a non-exclusive, worldwide license and rights to print, distribute, market, promote, and sell the Work in print and/or digital form. This includes all material submitted or created in conjunction with Work, such as images, author biographical information, marketing copy, summaries, quotes, testimonials, and third party reviews. In general, published works are copyright protected when released; however, KWP will help you register with the U.S. Patent Office to extend your protection for an additional charge and filing costs. In recognition of KWP’s substantial investment in creating your book, Author acknowledges that KWP owns the “work product”, defined as the designed, sized, and formatted files used to print and digitally publish your book.
1. Author represents and warrants to have sole ownership, authority, and right to the Work and enter into this agreement.
2. Author warrants that the Work is original and has not been plagiarized.
3. Author warrants that Work does not infringe upon any laws or rights, as well as free of liens and claims.
4. Author acknowledges that KWP (as well as Kingdom Winds LLC) is a “Christian” business dedicated to the publication of “Christian” content. From time to time, KWP may agree to publish and provide services for Work that may not be deemed overtly Christian in nature as long as it is consistent with Christian values and principles.
5. Author represents and warrants that content is not libelous, slanderous, obscene, pornographic, or defamatory. Notwithstanding, KWP reserves the right and sole discretion to reject Work, or decline to provide services for any Work, that it deems inappropriate and inconsistent with the values and beliefs of Kingdom Winds LLC and Christian doctrine and principles.
6. Author agrees to indemnify Kingdom Winds LLC and KWP against all claims, liabilities, damages, judgments, and expenses arising from publication of the Work and any breach of warranties.
Author may establish the retail price of the book (subject to terms and conditions of outside distributors and retailers); however, the retail price must always be high enough to maintain a positive net profit margin to Author across all channels after all costs and discounts are applied. (Author may choose to sell books purchased and held in his or her own inventory at any price regardless of profit margin.)
Net proceeds from sales in Author’s store in the KingdomWinds.com Marketplace are transferred to Author’s account with each transaction, and usually posted within 48 hours. For Amazon, Kindle, Expanded Retail Distribution, and the Kingdom Winds Store, Author net profits (or royalties) are paid quarterly. KWP, however, reserves the right to roll payouts to the next quarter until the amount exceeds $75. Author authorizes KWP to print and offer copies of the book for promotional purposes royalty-free.
Author may purchase copies of the book in any quantity at the then-current Author Purchase Price plus associated shipping, handling, applicable taxes, and merchant fees (3-4% of total.) The current estimated Author Purchase Price is included in the accompanying proposal; however, prices are subject to change as materials, print charges, shipping charges, handling costs, and other related costs vary. In general, larger quantity orders result in lower ancillary costs per book. Orders must be paid in full by check or credit card at the time the order is placed. The KWP Author Book Purchase Price includes the cost of printing, binding, publishing fees, and processing charges. Author is also responsible for shipping, handling, applicable taxes, and merchant fee (3-4% of total on credit card purchases.)
Other than when KWP has arranged directly with the retailer, Print-On-Demand (“POD”) orders to be shipped directly to customers are priced higher to reflect processing and merchant fees. POD book orders from Author must be electronically submitted to KWP for processing along with the relevant information for shipping and paid in full by credit card when the order is placed. If contracted by Author, pick, pack, and ship and inventory management fulfillment services are charged separately as a per unit cost.
KWP agrees to provide services in a workmanlike manner and strives to be as timely as possible without sacrificing quality. Turnaround times through the production phase (such as editorial, layout and design) are highly interdependent upon the quality and timeliness of Author submissions and responses as well as the size and complexity of the Work. Author also acknowledges that business demands will vary (and often are out of the control of KWP) and that this may impact service time frames.
KWP adheres to generally accepted industry standards to maintain marketability and printability of Work. KWP generally uses The Chicago Manual of Style Guide and reserves the right to determine the manner and style of formatting and typeset. Cover design and interior layout services typically involve an iterative process based on author input. Changes, special requests and additional iterations of work outside the normal process may entail additional charges on a time and materials basis.
Custom cover creation for your book involves the development of a creative design according to author input, book content and messaging, genre type, and visual appeal. It entails a graphic designer using design software according to required printing specifications with commercially available fonts, images, and vectors. It does NOT include custom artwork or illustration services.
The standard quote includes up to 3 standard image licenses and 1 standard font licenses provided by KWP standard suppliers. Premium images, premium fonts, additional fonts, additional images, or use of non-standard suppliers may result in additional charges. The process is an iterative process and may require multiple rounds. Kingdom Winds Publishing will make a good faith effort to create a design pleasing to the author; however, because of the open-ended nature of the process, our standard pricing is limited to a maximum of 12 hours work by KWP. Time in excess may be subject to extra hourly charges.
Standard interior layout and design includes the use of standard fonts regularly available to KWP in its font library. Custom interior layout includes the purchase of one standard (non-premium) font license. Additional and/or premium font licenses will entail additional charges.
Unless detailed as part of a special offer or in your custom publishing proposal, specific marketing and promotional services for your book are not included but are available for purchase. KWP, however, does run periodic marketing and promotions to help stimulate book sales at its own discretion. Author grants permission to KWP to use your book, author name, and book details in these promotions. Additionally, author grants permission to KWP to include your book in contests and giveaways to create consumer awareness and demand at no cost to you (or according to a subsequently agreed upon arrangement.)
Distribution channels for each book vary as detailed in publishing proposals and supporting documents. KWP may make additional specially negotiated wholesale arrangements available to author for participation from time-to-time.
Author agrees to submit all required materials, including completed manuscript, images, and required information within 6 months or an otherwise agreed upon time frame. Failure to do so could result in additional charges or termination of the agreement. This agreement may be terminated at anytime by either party upon 30-days written notice. All notices shall be submitted by Author both to publishing @kingdomwinds.com and Kingdom Winds Publishing, 6 Charleston Oak LN, Greenville, SC 29615.
Publishing services payment is due upfront or as detailed in a payment plan unless otherwise agreed upon. Author may pay via credit card or check.
This agreement renews annually and may be subject to change.
The laws of the State of South Carolina shall govern this agreement and its courts shall be the venue for any litigation. The parties acknowledge that this agreement is binding, including upon heirs, executors, administrators, and assigns.
